Terms of Service

Article 1. Operator Information

These Terms of Service governs terms and conditions of "AI Excuse Generator" (hereinafter referred to as "the App") provided by Akira Kawata (hereinafter referred to as "we" or "the Company").

You and the Company acknowledge that these Terms constitute the agreement between you and the Company, and are not an agreement with Apple. Apple is not a party to these Terms and has no obligations or liabilities regarding these Terms.

Article 2. Acceptance and Scope

By downloading and using the App, you (hereinafter referred to as "User" or "you") are deemed to have agreed to all provisions of these Terms. If you do not agree to these Terms, please do not use the App.

These Terms constitute the sole agreement defining conditions of using the App and apply to the entire relationship between you and the Company.

Article 3. Usage License

We grant you a non-exclusive, non-transferable license to use the App. You may use the App subject to following conditions.

• • Use the App only for personal purposes
• • Do not copy, modify, reverse engineer, decompile, or disassemble the App or any part thereof
• • Do not lend, resell, re-license, or distribute the App or any part thereof to any third party
• • Respect all copyrights, trademarks, and other intellectual property rights related to the App
• • Use the App only on Apple-branded products (devices owned or controlled by you)
• • Accounts associated with the purchaser may use the App through Family Sharing or volume purchasing, but the App does not have purchasing features, so this does not apply

Article 4. Prohibited Actions

You shall not engage in any of following actions while using the App.

• • Acts that violate laws or regulations
• • Acts that infringe upon the rights, property, or reputation of the Company, other Users, or third parties
• • Acts that violate copyright law, trademark law, or other intellectual property rights
• • Unauthorized access, virus distribution, or other fraudulent acts
• • Spam, phishing, or other fraudulent acts
• • Inappropriate acts including discrimination, defamation, or harassment

If you violate any of these provisions, we may immediately suspend or restrict your use of the App and take legal action.

Article 5. Intellectual Property Rights

All intellectual property rights to the App and all content included therein (text, design, logos, images, code, etc.) belong to the Company or our licensors.

Without prior written permission from the Company, you may not use, copy, distribute, modify, publicly transmit, or otherwise utilize any intellectual property rights related to the App in any form.

Article 6. Disclaimer

We are not responsible for any relationship issues, discomfort, or any other damages caused by using excuses generated by the App.

Excuses generated by AI should be used only as jokes or references. Please avoid using them in important business scenarios, important personal relationships, or situations involving legal issues.

You are using the generated content at your own judgment and responsibility. We do not warrant the appropriateness, accuracy, or legal effect of the generated content in any way.

Article 7. Limitation of Liability

The App is provided "AS IS" and without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We shall not be liable for any direct damages, indirect damages, consequential damages, or lost profits arising from the use of the App, even if we have been advised of the possibility of such damages.

However, this does not limit your statutory rights under consumer contract laws.

If there are any defects in any applicable warranties, you may contact Apple. Refunds may be processed according to the procedures specified by Apple. We have no refund obligation.

Article 8. Privacy Policy

We respect and appropriately protect your privacy. The collection, use, and management of personal information shall comply with our Privacy Policy.

Article 9. Changes to Terms

We reserve the right to modify these Terms as necessary. The modified Terms will become effective upon publication within the App or on our website.

If you continue to use the App after the publication of modified Terms, you will be deemed to have agreed to the changed Terms. Please check these Terms regularly.

Article 10. Governing Law and Jurisdiction

These Terms shall be interpreted and applied in accordance with the laws of Japan. Any disputes regarding these Terms shall be subject to the exclusive jurisdiction of Tokyo District Court as the court of first instance.

By using the App, you represent and warrant the following.

• • You or User are not located in a country that is subject to a U.S. Government embargo
• • You or User are not listed on any U.S. Government list of prohibited or restricted parties
• • You or User are not located in a country that has been designated by the U.S. Government as a "terrorist supporting" country

Article 11. Compliance with Third Party Terms

In using the App, you shall comply with applicable third party terms of agreement.

This includes Apple Media Services Terms and Conditions, but the App does not have applicable features.

Article 12. Apple's Rights

You and the Company acknowledge that Apple and its subsidiaries are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

Article 13. Termination and Suspension

You may uninstall the App and terminate use at any time.

We reserve the right to suspend, modify, or terminate all or part of the provision of the App without prior notice.

If the service is terminated pursuant to this Article, data stored on your device (history, favorites, settings) will be deleted when you uninstall the App.
